Appeals court: Woman's defamation suit vs. Trump can proceed

President Donald Trump is not immune from a defamation lawsuit brought by former "Apprentice" contestant Summer Zervos, even as his lawyers argued that the case should at least be deferred until the end of his term, a NY appeals court ruled on Thursday. The appellate court rejected this argument, and judges wrote: "We reject defendant President Trump's argument that the Supremacy Clause of the United States Constitution prevents a New York State court - and every other state court in the country - from exercising its authority under its state constitution".

Despite suggesting that he embodies the executive branch and has significant responsibilities, "the President is still a person, and he is not above the law", the court said.

Ms Zervos has repeatedly accused Mr Trump of kissing her against her will at a 2007 meeting in NY, and later groping her at a Beverly Hills hotel.

Both sides have continued gathering evidence while awaiting the appeals court's decision.

Zervos' lawyers say Trump's words were falsehoods that subjected her to threats.

Her lawyer, Mariann Wang, said in an emailed statements she was pleased the judges had ruled that Trump was "not above the law". Several other women have also accused Trump of improper sexual conduct.

The appeals court called Zervos' case "materially indistinguishable" from former Arkansas state employee Paula Jones's lawsuit accusing then-President Bill Clinton of sexual harassment. Last year, the NY attorney general sued Trump, alleging "persistently illegal conduct" at the charity he has run for 31 years.

That suit is also filed in NY state court, and Trump's attorneys had argued that his status as president should exempt him from state suits. In a June 2018 lawsuit, the Attorney General claimed the foundation was operated as a "shell corporation that functioned as a checkbook" for Mr. Trump, his campaign and businesses. Numerous allegations about misconduct at the Trump Foundation were first reported by The Washington Post in 2016. Zervos sued for defamation. She alleges that Trump "ambushed" her on multiple occasions, starting in 2007, and kissed her on the mouth, touched her breast and rubbed his genitals against her.

The court also ruled that Zervos had made out a sufficient claim of defamation, and her suit was not barred by California's anti-SLAPP law. "The result the Supreme Court reached in Jones. may well have been entirely correct". That lawsuit was dismissed by a federal judge in October.

In contrast to Daniels and her attorney, Michael Avenatti, Zervos and her lawyers have taken a low-key approach, a step that may help them negate claims that the suit is politically motivated. Trump also republished on Twitter a post calling Zervos' accusations a "hoax".

Zervos was among over a dozen women who emerged during Trump's 2016 campaign with allegations of sexual misconduct years earlier.
