Ghosn suffers high fever, interrogation suspended

"I have been wrongly accused and unfairly detained based on meritless and unsubstantiated accusations", the once-revered auto titan told the court.

Ghosn, who denies the allegations, has shown no signs of backing down.

Ghosn, who holds Brazilian, French and Lebanese citizenship, has been kept at the Tokyo Detention House facility since his arrest on November 19.

Ghosn lost an appeal against his ongoing detention, diminishing the prospects of an early release on bail.

Lawyers for the former jet-setting executive immediately said they would file a bail application, but have acknowledged that he will probably be detained until a trial. But the court rejected the request. His lawyers applied for bail, while acknowledging the slim chance of success. His detention period for the breach of trust allegations would have expired Friday if charges had not been filed.

Suspects in Japan are routinely held for months until trials start, and Tokyo prosecutors maintain that Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, is a flight risk.

Only embassy officials and Ghosn's lawyers are allowed to visit him.

Ghosn, who is reportedly suffering from a fever at his Tokyo detention centre, denies any wrongdoing, arguing in a dramatic court appearance on Tuesday that he is being "wrongly accused and unfairly detained".

Renault said in a statement Thursday that an internal investigation found all payments to its board members in 2017 and 2018 were in compliance with the law and "free from any fraud".

An individual convicted of aggravated breach of trust faces a fine of up to 10 million yen and/or a maximum prison term of 10 years.

Nissan said Friday it has filed its own criminal complaint against its former chief "on the basis of Ghosn's misuse of a significant amount of the company's funds".

He was served with a fresh arrest warrant on December 21 for allegedly shifting a private currency swap contract with losses worth 1.85 billion yen to Nissan in October 2008 and causing damage to the company by having it pay $14.7 million to a Saudi businessman, who guaranteed credit for Ghosn, in the following years.

As chairman of Nissan, Renault SA and Mitsubishi Motors Corp 7211.T , the globe-trotting Ghosn had access to a string of residences around the world, including additional homes in Beirut and Rio de Janeiro.

The Yomiuri Shimbun said US$100 million was paid to sales agents in five Middle Eastern countries from Ghosn's special "CEO reserve".

Ghosn has admitted that the ownership of the contract was temporarily transferred from his private asset management firm to Nissan but said the automaker incurred no losses.

According to Ghosn's defense counsel, Ghosn has had a high fever since Wednesday evening but his condition has improved.
