US courts to hear cases that weed-killer sold in UK causes cancer

Now a federal judge has ruled that there was sufficient evidence for a jury to hear the case that the company's weed-killer, still sold across the United Kingdom, is causing cancer.

A district court judge in San Francisco ruled Tuesday that hundreds of cases against Monsanto Roundup may now be taken for trials.

The first case to be heard is that of a former school groundskeeper, Dewayne Johnson, of whom doctors said is already dying of non-Hodgkin's lymphoma in just a matter of years.

The agrochemical company Monsanto is facing a lawsuit accusing them of having a weed-killing product which causes cancer.

While Chhabria's ruling is not binding on them, state court judges have been closely following the federal litigation and expert hearings. Monsanto has vehemently denied such a connection, saying hundreds of studies have established that glyphosate is safe.

"The scientific evidence is overwhelming that glyphosate-based products do not cause cancer", stated Monsanto attorney George Lombardi.

The plaintiffs will next have to prove Roundup caused cancer in specific people whose cases will be selected for test trials, a phase Chhabria in his Tuesday opinion called a "daunting challenge". "The best study of human beings who, like Mr. Johnson, are licensed pesticide applicators, concludes that glyphosate has no association with non-Hodgkin lymphoma". Farmers in California, the most agriculturally productive state in the US, use it on more than 200 types of crops.

The herbicide came under increasing scrutiny after the France-based International Agency for Research on Cancer, which is part of the World Health Organization, classified it as a "probable human carcinogen" in 2015. Homeowners, meanwhile, used Monsanto Roundup on their lawns and gardens.

Monsanto also pointed to sections of the opinion that questioned the plaintiffs' evidence.

The weed-killer contains glyphosate, a chemical that the US Environmental Protection Agency ruled was not carcinogenic in September. A draft report by the agency previous year concluded the herbicide is not likely to be carcinogenic to humans.
